Competition Terms & Conditions

1. Eligibility

To be eligible to enter the Giveaway, each entrant must be a legal resident of Queensland, Australia, and be eighteen (18) years of age or older at the time of entry. Entrants must also have a valid Instagram account. This Giveaway is void outside Queensland or where prohibited by law. Employees, agents, and immediate family members of Epic Hair Designs (the "Promoter") or any of its affiliated companies and partners are not eligible to enter.

2. Winner Selection

Upon completion of the Giveaway Period, a representative of Epic Hair Designs will review all eligible entries and randomly select one (1) winner using a random number generator (e.g. via Google’s random number tool). The draw will be conducted in a fair manner from all valid entries received. The selected winner will be notified via the email address and/or phone number provided (or through Instagram direct message if applicable) within a reasonable time after the draw. The winner will have 48 hours from the time of notification to respond and claim their prize. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 48 hours, or cannot physically attend a prize event or accept the prize for any reason, then that winner will be deemed to have forfeited the prize. In such a case, at Epic Hair Designs’ discretion, a runner-up may be selected as an alternate winner (also chosen randomly) and notified in the same manner.

3. Personal Information & Privacy

By entering the Giveaway, you consent to Epic Hair Designs collecting and using your personal information for the purposes of administering the promotion and awarding the prize. The personal information we collect may include your name, contact details (such as email address and phone number), and any other details you provide as part of entry. This information will be used solely for identified purposes, which include: verifying eligibility, contacting winners, arranging prize delivery, and adding entrant emails to Epic Hair Designs’ marketing communications list (e.g. newsletters or promotional offers), unless otherwise required by law.

Epic Hair Designs will share entrants’ personal details with third parties who contribute to the prizes of this Giveaway (our "collaborating partners"). For example, if a partner company (such as a prize sponsor like BRC or any other contributing sponsor) provides or fulfills part of the prize, the Promoter may share the winner’s and/or all entrants’ name and contact information with that partner for prize fulfillment, verification, or their own marketing purposes. Any collaborating partner that receives entrant information will be required to handle it in accordance with their own privacy policy and applicable privacy laws. Epic Hair Designs and its partners will protect your personal information in a manner consistent with our respective Privacy Policies and will not sell your data or use it for purposes unrelated to this Giveaway and our marketing, unless we have your consent or are required to disclose it by law or applicable regulation (for example, in response to a legal request or for insurance or safety obligations).

Your personal information will be stored securely and in compliance with the Australian Privacy Principles. Entrants have the right to request access to, or correction or deletion of, their personal information at any time. If you wish to withdraw from the promotion, opt out of marketing communications, or request that we delete your data, you may do so by contacting Epic Hair Designs via email at marketing@epichairdesigns.com.au or by using the Contact Us form on our website. Such requests will be honored in accordance with our legal obligations. Please note that deletion of required contact information before the Giveaway ends may result in your entry being void. 4. Prize(s)

The prize(s) offered in this Giveaway are not transferable to any other person, are not redeemable for cash, and cannot be exchanged or substituted for any other products or services. The prize must be accepted as awarded and as described in the Giveaway announcement. No extensions or date alterations on prize components will be permitted under any circumstances. Epic Hair Designs reserves the right to substitute a prize (or any portion of it) with another item of equal or greater value in the event that the advertised prize becomes unavailable for any reason.

5. Prize Collection and Usage

The winner will be able to collect or redeem their prize pack(s) at their preferred Epic Hair Designs salon location on a booked date of their choosing (subject to availability and any scheduling arrangements communicated by Epic Hair Designs). It is the winner’s responsibility to coordinate with Epic Hair Designs to schedule any salon services or pick-ups included in the prize. Each prize item or service included in the prize pack may be subject to additional terms and conditions imposed by the prize provider or collaborating partner. For example, certain vouchers, experiences, or products offered by a third-party partner must be used at specified locations or under specific conditions as defined by that partner. The winner must adhere to all such additional terms when using the prize.

All prize pack items must be collected and/or used within six (6) months from the date the winner is drawn, unless otherwise stated. Failure to use the prize within this timeframe may result in the prize (or unused portion thereof) being forfeited, and neither Epic Hair Designs nor the prize partner is under any obligation to provide a substitute or extension. The Promoter will not be responsible if a winner is unable or unavailable to use any element of the prize within the allowed timeframe.

6. General Conditions

• Acceptance of Rules: By participating in this Giveaway, each entrant fully and unconditionally agrees to abide by these Terms & Conditions (the "Rules") and the decisions of Epic Hair Designs, which are final and binding in all matters related to the Giveaway. Entrants must comply with all instructions of the Promoter. Non-compliance with these Rules (or any attempts to defraud or abuse the promotion) may result in disqualification from the Giveaway, at Epic Hair Designs’ sole discretion.
• Right to Modify or Cancel: Epic Hair Designs reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Giveaway (or any portion thereof) at any time for any reason, without prior notice. This includes (but is not limited to) the right to adjust dates, deadlines, or procedures in the event the Giveaway cannot run as planned due to technical failures, computer viruses, bugs, tampering, unauthorized intervention, fraud, Force Majeure events (e.g. natural disasters, pandemic, etc.), or any other causes beyond the reasonable control of the Promoter that could corrupt or affect the administration, security, fairness, or proper conduct of the promotion. If the Giveaway is terminated early, Epic Hair Designs may (but is not obligated to) select the winner from all eligible entries received up to the time of cancellation.
• Limitations of Liability: To the fullest extent permitted by law, Epic Hair Designs and its partners, affiliates, employees, and agents shall not be liable for any loss, damage, claim, cost, expense, personal injury, or death (including, without limitation, indirect or consequential loss) arising in any way out of or in connection with the entrant’s participation in the Giveaway or the winner’s acceptance or use of any prize. By entering, you agree that the Promoter is not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants or by any of the equipment or programming associated with or utilized in the Giveaway; (b) any technical failures, disruptions, or malfunctions (including, but not limited to, telephone, network, server, Internet Service Provider, or other connections, hardware/software issues, or failure of any email or entry to be received by the Promoter); (c) unauthorized human intervention in any part of the entry process or the Giveaway; or (d) technical or human error which may occur in the administration of the Giveaway or the processing of entries. Entrants release Epic Hair Designs and its partners from any and all liability, and any and all causes of action related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Giveaway or acceptance, possession, or use of any prize (except where prohibited by law). Any liability that cannot be excluded by law will be limited to the minimum allowable extent.
• Publicity Release: By participating in the Giveaway, each entrant (especially the prize winner) agrees to allow Epic Hair Designs and its collaborating partners to use the entrant’s name, Instagram handle, likeness, biographical information (such as city/town of residence), and any statements or content submitted as part of the Giveaway entry for advertising and publicity purposes in any media (including online, print, or social media), worldwide, without any further permission or compensation, except where prohibited by law. The winner(s) may be asked to participate in promotional activities related to the Giveaway (such as photos or interviews), and by accepting the prize, the winner consents to such participation and use of their image or likeness. The entrant waives any rights to inspect or approve any finished promotional materials and agrees that all such materials are the sole property of Epic Hair Designs (and its partners, as applicable).
• Identity of Entrant and Disputes: In the event of any dispute regarding the identity of an entrant or the holder of an entry, the entry will be deemed submitted by the authorized account holder of the Instagram account or email address provided at the time of entry. The “authorized account holder” is defined as the natural person who is assigned to an Instagram account by Instagram (or to an email address by an Internet service provider or other organization responsible for assigning email addresses). If a dispute cannot be resolved to the Promoter’s satisfaction, the entry may be deemed ineligible. Epic Hair Designs reserves the right to require potential winners to provide proof of identity and/or proof of being the authorized account holder associated with the winning entry.
• No Instagram/Meta Affiliation: This promotion is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms. Entrants understand that they are providing their information to Epic Hair Designs and its partners, not to Instagram. All entrants completely release Instagram (and its parent company Meta) from any liability associated with this Giveaway. Any questions, comments, or complaints regarding the promotion should be directed to the Promoter (Epic Hair Designs), not to Instagram.
• Governing Law: The Giveaway and these Terms & Conditions are governed by the laws of the State of Queensland, Australia. All entrants submit to the exclusive jurisdiction of the courts of Queensland for any disputes arising out of or relating to this promotion. This Giveaway is subject to all applicable local laws and regulations. If any provision of these Rules is found to be unlawful or unenforceable, that provision shall be severed from the Rules and the remaining provisions will remain in effect.
